Fair Work Australia rejects MSS Security Agreement

Commissioner Asbury of Fair Work Australia refused to approve MSS Security's Enterprise Agreement on Monday 10 May, after much deliberation.

LHMU Queensland was hopeful MSS's Agreement would not get approved given the poorly conducted ballot process MSS Security followed in an attempt to get their agreement passed.

It is disappointing that security officers are being forced to wait so long for a pay rise while MSS appear to be attempting to rush through a sub-standard agreement to avoid changes to conditions that the Modern Award delivered on 1 January 2010.

LHMU delegates will attempt to meet with MSS management in the near future to commence discussions in relation to MSS Security Officers negotiating improved wages and conditions.

LHMU delegate Peter Little speaks out ...

After hearing of Fair Work Australia's decision to reject the sub-standard agreement put forward by MSS, LHMU delegate Peter Little said:Peter_Little_security_officer

"If MSS Security Officers want a decent agreement, all MSS Security Officers need to stick together and fight for their rights .. be united and work together as a team."

When asked if he believed all MSS Security Officers join their union, Peter replied:

"Joining our union is the only way MSS Security Officers can have a collective say in what happens to our pay and conditions. Nothing will change unless we work together and speak as one united voice."

All LHMU members, employed by MSS Security are encouraged to attend an Organising Committee meeting scheduled for next Thursday 27 May 2010 at the Brisbane Office: 27 Peel Stree, South Brisbane.

I must agree with Peter Little. If we are to ever get a decent living wage, we MUST stick together. I'm tired of seeing EBA's from other industries and seeing the huge descrepancies as compared to what people in the security industry (whos jobs are to keep people safe) get paid.

I'll be at the meeting on the 27th and I would hope that everyone who is able to come, does.

I concur with Peter, I work for the other big security company and am a LHMU delegate and believe me things aren't much different on our side of the fence, trying to screw the worker as much as possible by paying as little as possible and decreasing our working conditions to increase their already healty prfits! Good luck in your bargaining with MSS.

I fully agree with Peters comments,I attended the Delegates confrance and was very please to see a few delegates from M.S.S. there,But we must not sit on our backsides if we want changes within our industrie.
First and foremoust we must ALL become members who are prepard to make a stand for our RIGHTS and CONDISTIONS and only by having a full active membership will this happen.
The days of Security Officers sitting back and expecting a few others to do all the work that is required have passed, its time for all members to encorage all thouse that are non members to join.
Remember we need your help,support,and partisepation it is only then we will get a decent pay for our efforts.

I agree we need more members to be strong in our campaigns to win better pay and conditions but, we also need to fight for equal pay and conditions for the possible hundreds of contract guards that MSS use.
Over the years i have noticed more and more permanent guards being replaced with contract guards, who are forced to sign substandard contracts with their employer if they wish to gain employment, they are paid rediculously low flat rates of pay, they have no vote in MSS agreements.
MSS will continue to contract work out to these shonky companies unless we unite and win SAME pay and conditions for for all guards working for MSS whether employed directly by MSS or are contract guards.
If we don't win equal conditions for the contract guards, MSS will eventually replace us all with contractors and who knows what conditions we will be working under.
I would be happier to see all security officers from all employers paid under the Modern Award as the minimum standard, then we would have a level playing field and a stronger voice in this industry, then if an employer wanted to attract new staff they would have to offer at least the minimum as set out in the award or offer a better deal to attract experienced and motivated officers.

Discussions at the recent convention about there being a standard rate of pay for all Security Guards across Queensland would be very beneficial as some guards work within small companies and it is very hard to negotiate pay rises because of the size of the company and the company's attitude. We have been told by our company that there will be no pay rises for another year and we have already gone 12 months without a pay rise. And it conditional upon Fair Pay Commission granting this. When I tried to pursue with the Union through Tony from Member Assist he was unable to help and I never really understood why. So I'm looking forward to the suggestion that was made at the Convention being pushed through in the very near future

As like Peter Little, I attended the LHMU Delegates Conference in Brisbane and voiced my opinion at the indifferences that Companies like MSS are putting on it Security Officers. I also agree that there should be a uniformed amount of payment for the services that we, as Professional Officers provide and the risks that we have to undertake whilst working for these Companies. I have been in the Security Industry for over 30 Years and have seen a number of Companies go down the road of paying(underpaying) it's staff and then going bust and leaving staff to face the consequences of no payment for services provided. I can remember when MSS was brought on charges of manipulating run sheets in Queensland, they will not learn. The Victorian Security Officers fought for their current payment award which is something that I believe that we should be doing.
Let us all stand together and say enough is enough to these Companies that will not pay the proper award payments and conditions to the Professional Security Officer's that we are.
